INFORMATION CLAUSE

In compliance with the obligation arising from the general regulation of the European Parliament and Council (EU) 2016/679 of April 27, 2016, on the protection of individuals regarding the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (Official Journal of the EU L. of 2016 No. 119), hereinafter referred to as GDPR, we provide the following information about personal data processing.

We inform you that we process your personal data, and you have the following rights.

2. For what purpose and on what basis do we process personal data:

• To conclude a contract based on your intention, and then to perform the contract, based on Article 6(1)(b) GDPR.
• To secure, establish, pursue, or defend against claims, which is our legitimate interest even after providing services to you, based on Article 6(1)(f) GDPR.
• For direct marketing and offering our products or services, which is our legitimate interest even after providing services to you, based on Article 6(1)(f) GDPR.
• For direct marketing and offering our products or services, based on your consent, under Article 6(1)(a) GDPR.

3. Data may be transferred (if necessary) to the following entities:

• Our subcontractors and external entities providing legal, IT, hosting, and advisory services.
• Property managers.
• A notary public.
• Postal operators or courier companies.
• Relevant tax authorities and other authorized government and local administration bodies, as well as judicial authorities and other authorized institutions. However, we may only provide the minimum scope of information necessary and only if it is essential. Moreover, we do not transfer data outside Poland/EU/EEA.

4. Personal data retention period:

• Data processed to conclude a contract will be retained for the duration of negotiations and for 25 years from the conclusion of the final sales contract in the form of a notarial deed.
• Data processed in connection with the contract conclusion will be retained until the end of the limitation period for any claims and until the end of the period for verifying compliance with fiscal and administrative obligations incumbent on the Administrator in connection with the contract conclusion.
• Basic contact data processed in connection with direct marketing of our services will be retained until an objection is made against this purpose of processing or until consent is withdrawn if the data is processed based on such consent or until it is determined that it is outdated.

5. We inform you that you have the following rights:

• The right to access your data, receive a copy of it, and to rectify (correct) it.
• The right to erasure of data – if you believe that we cannot process it.
• The right to restrict data processing – if you believe we have incorrect data or are processing it unlawfully and you do not want it erased because you need it to establish, pursue, or defend claims, or if your objection is being considered.
• The right to object to data processing for direct marketing purposes, and after making such an objection, we will stop processing the data for this purpose.
• The right to data portability, which includes requesting that we provide you with your data in a structured and commonly used format, as well as the possibility to instruct us to transfer this data directly to another indicated entity.
• The right to lodge a complaint with the President of the Office for Personal Data Protection if you believe that the processing of your personal data violates data protection regulations.
• The right to withdraw (at any time) the consent given for the processing of personal data (which we process based on your consent). However, this does not affect the legality of processing conducted based on consent before its withdraw

6. Information on the voluntary nature of data provision and the consequences of not providing it:

• In the case of contracts – providing data is a condition for concluding or performing the contract, and consequently, the contractual obligation may not be fulfilled.
• In the case of processing data due to the Administrator's interest – providing data is voluntary.

7. Your data will not be processed automatically, including in the form of profiling.
8. Your personal data will not be transferred to a third country or an international organization.
